1.Introduction & Acceptance of Terms
Welcome to Ya Marhba QR ("Platform", "we", "us", or "our"). These Terms of Service govern your access to and use of our web platform, APIs, and related digital hospitality services, including digital invitation design, guest list management, encrypted QR entry passes, check-in scanning, and event attendance analytics.
By creating an account, hosting an event as an "Organizer" or "Host", or accessing an entry pass as an invited "Guest", you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
2.Nature of Services & Gate Security Disclaimer
Ya Marhba QR provides software technology that allows organizers to create invitations, generate encrypted entry QR codes, and scan those codes at event entrances to confirm digital validity.
Ya Marhba QR is purely a technology provider and does not provide physical security, venue bouncers, or law enforcement services. The Event Organizer, venue operator, and physical gate staff retain exclusive discretion and legal responsibility for physical admission, venue capacity control, identity verification, and attendee safety. Ya Marhba QR is not liable for entry disputes, unauthorized entries, or denied admissions.
3.Host Responsibilities & Data Consent
As an Event Host or Organizer, you warrant and represent that:
- Data Accuracy: All phone numbers, emails, and names uploaded to the guest management module are accurate and up to date.
- Prior Consent: You have obtained express consent from each guest prior to uploading their contact details and initiating invitation delivery.
- Anti-Spam Compliance: You will not use the Platform for unsolicited marketing, spam, harassment, or random distribution.
- Data Ownership: You retain ownership of your guest lists and bear full responsibility for the legality of their collection.
4.Third-Party Messaging Channels & Delivery
The Platform utilizes third-party telecommunications infrastructure, including Meta (WhatsApp Cloud API) and transactional email providers, to dispatch invitations and RSVP confirmations.
Delivery speeds and receipt depend on telecom networks, recipient phone states (airplane mode, blocked numbers, WhatsApp account standing). While we maintain high-availability dispatch queues, we do not warrant instantaneous delivery when external carrier conditions are beyond our technical control.
5.Encrypted QR Entry Passes
QR codes generated by the Platform are unique to the authorized recipient and their allocated guest count.
- Passes automatically transition to exhausted status once the allocated admissions are completed at check-in.
- Unauthorized reproduction, tampering, resale, or forging of digital entry passes is strictly prohibited.
6.Limitation of Liability
To the maximum extent permitted under applicable law:
- Ya Marhba QR shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, event disruption, or reputation damages.
- Our total aggregate liability to any host or user for all claims arising out of or related to an event shall not exceed the actual fees paid by the host for that specific event.
7.Intellectual Property
All trademarks, visual assets, software code, invitation template designs, calligraphy motifs, and user interfaces are the exclusive property of Ya Marhba QR and protected by international intellectual property laws.
8.Subscriptions, Credits & Refund Policy
Paid digital packages and message credits are governed by the following commercial terms:
- Immediate Digital Provisioning: Digital credits and premium event tiers are activated and allocated immediately upon successful transaction.
- Refund Eligibility: Hosts may request a full refund within 14 days of purchase provided no guest invitations, WhatsApp dispatches, or dynamic QR passes have been generated or transmitted. Once invitations have been dispatched or digital credits consumed, services are deemed fulfilled and non-refundable, except in verified cases of prolonged system failure solely attributable to our platform.
- Event Rescheduling: Hosts may modify event dates, times, and venue locations within their active tier validity period without additional platform charges.
9.Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.
